Insurance Company’s Failure to Timely Investigate And Settle An Uninsured Motorist Claim

Our client was driving home from work when he was rear ended by an uninsured driver. Our client’s vehicle was totaled. He suffered a traumatic brain injury and was off of work for a considerable period of time. When our client reported the claim to his insurance company, the company gave him a “lowball” offer. We filed suit, alleging, among other things that the insurance company’s failure to timely and fairly investigate, evaluate, and settle this case was a bad faith. This case was resolved prior to trial.
